It all started last February when we bought Tracy a Freelander Turbo Diesel from a garage in Manchester, Mottram Small Cars at Tintwistle, to name and shame.
Not having this kind of vehicle I wasn’t sure what to expect powerwise, and lets face it most cars seem sluggish after driving the GTO, so when driving back over the Snake Pass to Sheffield it seemed to struggle I put it down to that, and the fact it’s a heavy car.
As Tracy only used it to tootle around with our dog and back she didn’t feel the problem, it was only a month later when we went to see some friends in South Wales that we took it on the motorway and were horrified to find it wouldn’t go over 60, imagine the embarrassment when lorries and caravans were whizzing past us!!
Of course it went straight back to the garage, we asked originally for a full refund, but the garage told us they were within their rights to sort the car out before getting to that.
Weeks went by and they still had the car, we made phone call after phone call without managing to get hold of the main man, and left message after message which were completely ignored. At this stage we started get a bit pee’d off. It was only by ringing from a different mobile, a number he didn’t know, did we finally catch up with him.
Of course he denied all knowledge of receiving the message, and claimed he’d been off work on paternity leave.
We finally got the car back 4 weeks and one day later, during that time, the total repairs were new Glo plugs and new MAF Air Sensor. He claimed to have taken down the motorway and it was fine.
Stupidly I took his word on this and took the car back to Sheffield, only to find it was no better.
Not only that, when we collected the car, the rear cover of the wing mirror was missing!!! Again the main man was out when we collected it, and when I pointed the missing part out to the mechanic he said that it was like that when it went in, which was total lie.
Now I was ANNOYED, I ‘gently’ persuaded him to get his boss on the phone, which he did, after a few choice words, he agreed to send us a new wing mirror cover in the post during the next week as he would need to source one. I insisted - again ‘gently’ lol, that the mechanic gave us a signed receipt confirming they owed us a cover.
We decided this shower of a garage, which wasn’t just a car dealers, it was also a repairing garage and MOT testing station, didn’t have a clue about the problem with our car, and we weren’t going to be happy until a Landrover Specialist looked at it. We needed an expert opinion before taking the fight back to Manchester.
We had some diagnostics tests done at our own expense at a place called Ridgways in Rotherham, who are Landrover Specialists. They confirmed a permanent wiring fault to the fuel pump and that further repairs needed to be carried out. (this fault had been there well before we bought it)
We took this information back to the dealer complete with a letter Tracy put together for him to sign, basically agreeing to reimburse us for the repairs.
He signed it, it went in, it was repaired, we paid the bill and sent it him for re-imbursement.
That was June last year, and 2 months later, we had no re-imbursement and no wing mirror cover, we’d had lots of promises of both, but neither came to fruition.
At that point we lost patience, and jumped on the Net and filed a claim against him on Moneyclaim Online, easy peasy, £35 and off it goes.
As far as we were concerned we had him by the short and curlies, we had a signed letter confirming he would re-imburse us, and a signed receipt regarding the wing mirror cover.
To our horror he responded to the Court Papers totally defending his claim, he denied all knowledge of offering to pay, of the promise to replace the wing mirror cover, he even said he’d given us money to cover our petrol and offered us a courtesy car, all of which was fabricated.
So the date 28th January 2009 was set to thrash it out in court, and boy with all the evidence we had was I looking forward to it.
He wasn’t oblivious to the letter etc, as in the normal way, we had to provide the other party with all which we would be relying on in Court, it was a complete mystery to us why on earth he thought he could win.
Then, low and behold on Monday the sob story arrived, a letter from him saying his father was ill, his business wasn’t going according to plan (I f**kin wonder why) and offering us £250 in full and final, I bet you can guess where that letter went, well had he been within arms reach it would have gone somewhere a little less pleasant than the bin, but he wasn’t.
On the day, he didn’t turn up, which I was a little disappointed with to be honest, I was so looking forward to coming face to face with him again.
He’d sent the judge a different letter to the one we got, basically giving the impression that his father was on death’s door and that he was an only child looking after him, at that stage the judge seemed to be considering postponing the hearing, however when she read our letter which just said his father was ‘not well’ but business wasn’t going according to plan and he didn’t want the hassle of coming to Sheffield, he lost all credibility with the judge, and the case went ahead without him.
When she went through all our evidence she totally agreed with our case and also added an extra £50 costs to him.
